Default THP attempting to find $$$? Motion requesting sale of Whitfield and KH Lots

See subject.

Looks like THP is trying to generate cash flow by letting loose some of the properties.

Hopefully for the communities left behind, this can be your exit from THP!

Do you actually think we want our house that has been sitting for over 7 months?

I wish that (TH) Properties ROTS IN HELL FOR ALL THE HEARTACHE THEY HAVE CAUSED EVERYONE.

I am hoping that next year I won't ever have to hear their name again.

Of the KHill lots, one is a model house, one is just a poured foundation, and the other is a empty lot with a huge dirt mound

According to THP website, they have 8 projects. (7 if you don't count Wynstone)

This will finish two of their projects. With only 5 active projects left, can Chapter 7 be right around the corner.

Maybe we will finally get some closure to all of this!

From the list of lots they would be selling it looks like more than 7 are missing. Tax records show that the following lots are still in THP's name and these are not on the list:
Lot #58 Halifax Model Home.
Lot #60 Hamilton Model Home.
Lot #220 Complete home on Windmill. There was supposed to be a buyer for this home.
Lot #304 Started home on Constitution (this was supposed to be the sales rep's house).
Lot #303 Top Soil pile on Sleepy Hollow.
Lot #210 started quick delivery home on Windmill, no siding.
Lot #192 started quick delivery home on Buck Hill ln, almost complete.

I'm not that framiliar with the newer section but I think there are some started homes in that area missing from the list. Lot 284, the lot with just the foundation dug, is on the list so it doesn't look like they plan on building that one.

What I find funny is the quality of these documents going to the court and how much they must be paying someone for them. There is no "Windy Busy Ln", it's Windy Bush Ln. Also Lot 265 isn't on Dogwood Ln it's on Sleepy Hollow Ln.

We are the creditors for the empty hole on Lot 284, which appears to be part of TH(P)s sale attempt. If we're reading this right, it looks like the bidder can either choose to accept or reject our contract? I know I've read the paragraph in our AOS that states it is transferrable, but it looks like they are allowing the bidder to decide whether they would want to assume our contract... If they don't assume our contract, then is it TH(P)s responsibility to "cure" their own default, or in other words, send us a check for our deposit amount?

Regardless of whether we will get our money back or not, we will not be buying a house in Whitfield (just in case there are any bidders perusing the website).

If your money was put into escrow you will probably get your money back if the bidder does not assume your contract. If you are like us whose money was not put into escrow...You are _ _ _ _ out of luck.

If our courts made them responsible for breaking the law and not putting EVERYONES money in escrow as the law states, it should not only be those who had it in writing who get their money back, it would be everyone!! The law is the law and if you or I broke it, we would pay the price! Why are they allowed to break the law with no consequences????????
