I've been wondering this myself. I understand that the bankruptcy proceedings only involve money. However, if someone could find out that their deposit did not go into escrow, but, rather, went into operating funds, could they go to the police and open a criminal case against THP?

I figured that since no one has accused them directly of anything criminal, that's why there is not a criminal case against them.

Actually, I think someone pursued this with the MontCo DA's office...or at least informally talked to them about it. The long and short of it, I think they person was told "good luck"

See that's what gets me fired up. Our money was not deposited into escrow, even though the memo on the check that we wrote to them says "Lot 284 ESCROW! These ***holes lied and cheated their way to where they are now, and still the bankruptcy court will not hold their feet to the fire! If they sell our contract, and the bidder doesn't accept it, then THEY ARE VIOLATING THEIR OWN AOS, which clearly states they would refund the deposit we gave them. But there's no money! F-bomb. Merry Christmas.

And if they're selling the remaining lots shouldn't some of that money go to refund our deposits? I already know the answer to this question - bank gets paid first. Just the usual Festivus Airing of Grievances - 'Tis the season.

You would be better I think if you contacted the Fort Washington FBI office. I believe you will not get any help from the PA Attorney General office. The FBI will investigate it for the US Attorney General. You could try contacting the US Attorney General, but I believe the FBI does their investigations.

Not so sure why or even if the FBI would pursue such a claim, for a variety of reasons.

A little unrelated, but it looks like another house is being built up the street (Kingston Hill). I guess they got more money to keep going. I thought it was only for the few that just got done.

Did you have a chance to meet your new neighbors yet? I wonder if they had an official real settlement or if it was more like a, keep this under your hat sort of deal? How long were they waiting to settle?
