Default Bank of America - Relief from Stay - Biltmore Estates and Late Phase Northgate

...

This could be the document that MANY people have been waiting to see filed.

I know I will be reading through this one VERY attentively.

Let's go.

I want to hear the sound of construction again.

Six months is a LONG time, contrary to what THP's representation puts forth in the filings.

I am "Unfairly Burdened" with liens due to THP's inabilities to pay their bills :

~2k - B&F Insulation - A Masco Company
~11k - ServiceMark - A UGI HVAC D/B/A

I'm still waiting, THP :

"We are working diligently with vendors and lenders to develop a restructuring plan that includes an agreement by the mechanics lien holders to release liens against completed homes. Our discussions have been encouraging, and we intend to see that all legal action is taken to ensure that no homeowner is unfairly burdened by these liens. We continue to specifically address this issue in our discussions. Our goal is to reach the best possible outcome for all parties as soon as possible."

Default Wtf thp?

All along you have stated that you are TWO WEEKS away from settling on resuming Northgate. Now, comes BoA saying that they have no confidence in you and want to FORECLOSE on the development.

Personally, I have more trust in BoA cleaning up that mess you left than you do! Not that I am a fan of B(ailout) Of America, but at least they are a GOING CONCERN.

THP - Your "10/27 Plan" was a joke! The lenders have spoken........CHAPTER 7!

Default Shortening of Discovery

Its a lot of tying up some loose ends, but it's VERY nice to see BoA so determined to look for an outcome for their projects.

THP or otherwise, as someone living in this day in and day out, I would love to see this mess come to a conclusion.

What they have left behind is not only unsightly, it's down right disgusting.

And the sooner something happens, the better.

Default W.t.f?

That is about all I can say after reading this.

So, they want to get back to work, using collateral of BoA, but just ignore all of the things they put forth like PAY OFF LIENS AGAINST HOMEOWNERS or COMPLETE INCOMPLETE HOMES in NG and Biltmore?

Way to go TH(P).

Leaving your customers, like your debt, behind appears to be the sentiment.

UNREAL.

How in the world is a NEW homebuyer going to buy these homes when they can see what can happen to them!??!!!?

This is some of the most amazing crap that THP has pulled up to this point. They are now making motions to the court telling them that they don't want us to wait to get in our homes, this absolutely blows me away that they are acting like they care about what happens to us. FYI it has been at the least 3 MONTHS SINCE I HAVE SPOKEN TO ANYONE AT THP (and 6 MONTHS SINCE THEY HAVE CONTACTED US, THIS IS BEFORE THE DECLARED BANKRUPTCY) Stop acting like you give a crap what happens to any of us, all you give a S H I T about is $$$$$$$$$$$$$$$$$ in you pockets. You scumbags have put OUR LIVES ON HOLD and don't contact us to to give us any idea when we can expect to move on. If anyone from Bank Of America is on this site i would advise you to check into THP'S numbers on the amount of people that are actually still going to buy homes from them cause i'll bet you that it is about half that they are saying. TIM AND TODD THANKS FOR SCREWING UP MY LIFE I HOPE YOU BOTH BURN HELL!!!!!!!!!!!!!!

Default update

Just for a FYI ! Here we are a month later and they still have not started work on our house. Yes thats right a whole month. Just 1 delay after another. If it isn't the paperwork being filed on time, or the damn judge talking off for a week and not signing the paperwork. Or the inability of THP to think 1 step ahead to hummm i don't know maybe talk to the people at the township the day after the motion was approved in court to get the ball rolling again. After all you ceased all operations for over 6 months. No one is going to be all open arms about the messes you left and abandoned.

sorry my rant is over now
