That is the problem with Chapter 11....While good people suffer, the courts protect the failed business practices of a company..This allows them to peter along looking for ways even though they lack the resources, financial backing, or the business sense to make the best decisions....I have said it many times...For a business to succeed this re-organization process, they themselves must reorganize...Implementing the same hierarchy will indeed lead to the same failed results..

And therein is the problem.

There are two obstacles in THP's way at this point :

1 - They have no money (as demonstrated in their filings)
2 - They do no not wish to give up control (as demonstrated in their filings)

Until one of these two things change, nothing will move forward.

The two obstacles are Todd and Tim and this point they need to stop ****ing with people lives and move on what every that might be. But either way let us all go free and move on with are lives.....

Default Building on that...

The solution is so seemingly simple, it's painful to have to watch it continue going on in the manner it is today.

Part one :

Give control to the subs and vendors that do the work.

They were the ones doing it all along anyway, so why not put them at the helm?

Part two :

Let TH(P) market the homes / stay at that level if they wish to remain "involved". But, maybe, reconsider the current marketing being put forth!

Part three :

Get the following funds setup for customers -
Warranty / Service
Liens / Completion of ALL Homes
Deposits / Escrow

Part four :

ACT on above funds. For everyone.

Part five :

Do everything else .. Get under way...

Part six :

Rebuild the tarnished THP name

Part seven :

Profit?

I don't have any of it.

And I don't plan to rest until I do.
Amen. Time is not on anyone's side at this point and this waiting game has gotten real old.

Looking back over the last few months, I think of how much time was wasted "hoping" for the "two weeks, two weeks" to come true, how much time we all spent scouring the dockets, finding information, doing what we could to find out something, anything. And here we all are......

Exactly.

Quite frankly, wheels were spinning in the opposite direction of the way the needed to go.

The filings weren't used in the right manner.

Once I find the right person(s), I intend to put them to use.

How can they possibly expect people to wait - it has been 4 months already, and they haven't even had the courtesy to contact any of us. I think it is completely ridiculous for them to think that people are going to wait around.

“…THP still intends you build your home….” Well, I intended to be in my home months ago, and that didn’t happen did it?

But I thought that all the court papers said that THP is focusing on customer outreach with their skeleton staff?

Default Trying to pull one over on us

I received a call from the wonderful Dave W yesterday, with some "good news". Our house is all but a fireplace finishing completed, and so therefore were offering us to live there for free until they could reach a settlement date. I asked when they thought that would be and he said that they didn't know. That they are finally in talks with Harleysville Bank and the bank is cooperating to try and reach an agreement(which we were told a month ago, would be completed by the end of Aug!). It may of sounded good in the beginning because we need a place to live at this point. (being 5 months pregnant sleeping on a fold out sofa isn't really the ideal relaxation at night I need) However, how do I know that in 30 days I will be forced to move out again cause you can't reach an agreement? How do I know that this won't go until Dec and because of all your mistakes, we lose our tax credit? Are you going to then discount the home 8 grand? Ha, NO! Not to mention, if you legally aren't able to touch a home in that development, how is the township supposed to approve a permit of occupantcy? Aren't these the games that got you in trouble?? Lets be serious here. Now that we have no choice, and I cannot trust this company as far as I can throw them, we are done. You have lost your money. Go ahead and come after us, but I'm not letting my family or myself suffer anymore. Good luck to the rest of you!

FYI - That same fireplace that the home is lacking is likely being supplied by the same company that has a lien against my home and many others. (B&F Insulation / Synergy Insulation).

I would hesitate to say with full confidence that you will see it unless they have really worked out some type of arrangement.

And, if there is one, perhaps working in parallel to REMOVE LIENS AGAINST HOMEOWNERS that paid in full, in good faith for their homes wouldn't be a bad idea either.

Regardless, good luck to you in whatever is next for your family. I hope that it is the experience that purchasing a new home is supposed to be.
