Default THP's response to Susquehanna's motion requesting relief of stay - THP

It took some time, but THP has a response for the motion put forth by Susquehanna bank regarding Burbank Grove and other issues.

(in regard to : Susquehana stepping up to the plate! "Burbank grove has ground to a halt"!)

LOTS of information in this one. There are things in here that don't only apply to Burbank Grove / Susquehanna.

And, finally, the boiler plate does appear to have been adjusted to properly demonstrate the current state of THP.

I am "Unfairly Burdened" with liens due to THP's inabilities to pay their bills :

~2k - B&F Insulation - A Masco Company
~11k - ServiceMark - A UGI HVAC D/B/A

I'm still waiting, THP :

"We are working diligently with vendors and lenders to develop a restructuring plan that includes an agreement by the mechanics lien holders to release liens against completed homes. Our discussions have been encouraging, and we intend to see that all legal action is taken to ensure that no homeowner is unfairly burdened by these liens. We continue to specifically address this issue in our discussions. Our goal is to reach the best possible outcome for all parties as soon as possible."

Default 10a

10a mentions that the "employees are back at work".

Does that mean everyone can get service? 6 month walk throughs? The year?

Funny that I go by their offices frequently and rarely see anyone there. When there are people inside, I would hardly consider it to be enough to operate the company.

Question Th (p) when do they surrender?

It appears as though TH does not have a real good chance of emerging successfully from this Chapter 11 fiasco.

How much time does the system give them before forcing them to file Chapter 7?

Does anyone really know? I have had people guess, but many of us are curious how long they have to play in the courts?

Also- Does anyone know when Skippack Twp is allowed to force the Bond Company to commence making improvements. It has been at least 60 days since the courts put a hold- yes?

I believe they are supposed to be following up with the bond company this week from what I understand.

Default Creditor Committee as well has joined in

Looks like the silence has many different offshoots of workings...

Hopefully everyone can quickly and easily be satisfied this time around.

I was told yesterday that they are still working w/ banks & will hopefully have another PLAN (not that work can begin) in a MONTH....so I guess they'll at least fight that long.

wow. Another month huh. Let's see....what are we supposed to do in the meantime?

Also, it's interesting how they've subtly moved away from the "two week" guarantee as of late......anyone else notice that?

This could play out for many more months to come, unfortunately. But, the longer it takes, the worse it becomes for all involved.

Default bond

Skippak can pull from that bond at any time I believe. The 60 day stay is well over - I believe was over the end of last month. So hopefully they are progressing with that?? would be damn nice - at least....it would give a small hope to those of us in Biltmore.
