Default Where's the Beef?

These court dates seem to be all inconsequential in most cases to the big picture - getting abandoned developments back in progress.

Where's the Beef?

All joking aside the beef in this case is DEBTOR IN POSSESSION financing (after all last month it was pooped on and handed back to them with a NO!)?

This is a tough case. Again and again we see the debtors had NO EQUITY in developments they are(were) building. The debtors have demonstrated in 4 months that they cannot get any financial institution to finance them to complete these lofty projects. The principals of the debtors (T&T) have even failed to pay the IRS! The debtors couldn't even buy PC's in 2006 - rather they leased them!!! (See CSI filing). Chapter 7 (Liquidation) seems like the fastest and best hope for ever getting these projects moving again.

Their marketing effort was brokering with Gay Davidson Group (I'm sure on a % basis) with 3rd grade english on a faux press release? Davidson should know by now that anything TH/THP related is held in a lower regard than a Michael Jackson daycare center!

THP seems to be just using the bankruptcy process as a delay tatic. Maybe until the Real Estate Market improves and they might have a chance of getting a reasonable DIP financing deal?

At least every time most people see a maroon vehicle they laugh at Tim and Todd.

"We are working diligently with vendors and lenders to develop a restructuring plan that includes an agreement by the mechanics lien holders to release liens against completed homes. Our discussions have been encouraging, and we intend to see that all legal action is taken to ensure that no homeowner is unfairly burdened by these liens. We continue to specifically address this issue in our discussions. Our goal is to reach the best possible outcome for all parties as soon as possible."

Looks like the Brubacher stuff is set for this upcoming week.

Unless it works itself on its own, this could be a challenge to a reorg plan if it consists of Burbank Grove.
