I believe that they can release me, but I also believe that when it comes to the money, the courts would decide...but I see your point..HA is NOT in ANY of the filings.

No, they CAN release you from the agreement.....since the money is held by Hendricks Abstract, a third party escrow, nothing has to be done with the court. It merely comes down to a matter of THP releasing you from the agreement of sale. The court has no position whatsoever in any of that. The problem, if I remember it correctly, is that THP had not agreed to let you out of the agreement.

Maybe its a matter of THP being concerned with how the creditors will react to THP releasing a homebuyer from their contract with their money in true escrow. Any insight from the creditor's committee, B_robert?

none here on that issue specifically. But conceptually hat's something they have to grapple with and clearly could be part of their "strategy." As, I've said before, the Agreements represent value to THP and creditors...therefore, prematurely releasing customers could impact future plans...

that's not to say, however, that they can't, because they clearly can.

My letter is in my office, but if I remember correctly the letter specifically stated tht the courts had to release them & they (THP) did not have the power. Now....if that is not the case....That is (to little old me a non lawyer) fraud....of course I say this without re-reading the letter...which I will do tomorrow at work.
