Default Homebuyer Bankruptcy Filings? THP - T.H. Properties - Escrow Issues

Have any THP homebuyers filed any pleadings / motions in the bankruptcy court (or other court) yet with respect to their agreement of sale / return of deposit?

Check the Philadelphia paper thread at the top of the sticker threads and see the results first hand.

sorry admin, not sure what you mean....i'm new. i see the phila inquirer thread with an article from i think 6/11. is that the article you are referring to? if so, i don't see all of the filings in that article.

We're considering it....depends on what we can find out from our lawyer with regards to when/if Barton Ridge is going to be approved/denied in court.

Right now....the BBB is telling me to file a proof of claim form to the Bankruptcy court...here's a link to that form....http://www.uscourts.gov/rules/BK_For...010_1208v4.pdf

...and for the most part, that's about the only filing you might need. There is no proof of claim deadline yet, so not hurry.

I was just about to call search for a contact # on the Bankruptcy website to see if I needed to file anything else to be let out of my contract. This is all I'll need?

I would assume that if I got my $ back, I'd be out of the contract.

no, your situation is slightly different because you're looking to break your contract. This is only a place holder for those owed money....your attorney should have you covered on what you need.

We sent a letter to the Head Trustee in charge of this bankruptcy. He received the letter today, so I have no idea what the outcome is going to be.

I do know, that writing to THP's Bankruptcy lawyer is a MAJOR waste of time. Typical lawyer speak and arrogance from that firm. They are NOT on the side of the home owner, and they have THP in their best interest.
