But, yes, you do want to claim these items. If you did not get them, and you paid for them, then they are valid claims.

And these are just forms that you need to fill out and provide the details requested within. You do not NEED legal representation, but, if you feel queasy, it may be warranted. You only need to question what will the return on the investment be?

If you also would like, I can recommend legal representation that is very familiar with the case.
The only thing I'm worried about is that I do not want to have to pay for a lawyer and to have to go to court for these things. Yes I am not happy that I am going to have to pay for these things and not get my walkthroughs, but that is not something that I feel is worth paying a lawyer for. I'd much rather take the small loss than have to pay for a lawyer and worry about court dates and such. So in essence, if I file a proof of claim for the things THP did not deliver, will I eventually have to go to court over this stuff?

I don't believe so.

That bridge has not been crossed yet, but, I guess that could happen if they try to deny a claim.

You just want to take the time to include whatever documentation you can. Settlement sheets showing that you did indeed pay for a full house with all the trimmings such as a yard... Quotes for completing a yard (not just a random 1 million dollars) etc... Things like that.

If you feel comfortable handling that, in a non-legal opinion or advice manner, I think that says you can fill out the form yourself.

You might want to review what TH Properties representation has said regarding their own reorganization plans :

According to the mailer sent (available here - http://www.wheresbuilder.com/THP-Ban...Homeowners.pdf) :

"4. ANY PERSON OR ENTITY (EXCEPT A PERSON OR ENTITY WHO IS EXCUSED BY THE TERMS OF THE BAR DATE ORDER) WHO FAILS TO FILE A PROOF OF CLAIM OR INTEREST ON OR BEFORE THE APPLICABLE OF THE BAR DATES SHALL BE FOREVER BARRED AND ESTOPPED FROM VOTING UPON, OR RECEIVING DISTRIBUTIONS UNDER, ANY PLAN OR PLANS OF REORGANIZATION OR LIQUIDATION IN THESE CHAPTER 11 CASES."
