To my knowledge, Hendricks didn't file bankruptcy. My money is not with THP..but with Hendricks. I fully understand that Hendricks own both companies, and I have a wirtten statement saying my money is in Escrow with them and NOT THP.

....so you're biggest obstacle is getting out of the AOS without harming the escrow....it SHOULD be waiting for you with Hendricks Abstract.

B_Robert - That's my whole point, why am I being told to petition some bankruptcy court, when THP doesn't even have my money in the first place?

My Fiance got off the phone with THP's bankruptcy lawyer, and she had our letter from Hendricks in her hand. She saw that THP doesn't even have our money, but yet..I have to ju8mp through these freaking hoops to get it back.

I swear my head is going to explode!

Its because your Agreement of Sale is still "valid" in the eyers of THP, thus they won't part with the money because it would be them rejecting the AOS.

I am in the exact same boat- but I realize that our contract is what is valuable for them- negotiating with banks, etc

Those who want OUT though they have their deposits in ESCROW.
and those whose contracts have been breached cannot get OUT either because their deposits are with THP.

Can I file Chapter 11 please(any chapter that protects us is fine doesnt have to be 11)?? before THP comes claiming that we cant get out of this mess??

The Proof of Claim seems to be for people who have deposits with THP for undelivered homes. Does anyone know if this form should be filed by those for whom THP still owes work that still uncompleted? I'm referring to those who settled on a home but have punchlists, driveways, lawns, etc...that are unfinished.

Its not secured, but it is likely your only way to ever see money for any of those things.

Pennies on the dollar, but pennies > 0.

Get quotes too - you need to back it up. It shouldn't be willy-nilly numbers.

Also - to those of you with no warranty and no warranty in sight.. Think about that value lost as well.

My Fiance was told today, by THP's bankruptcy Lawyer, that we have to Petition the court to get our money back. For those not keeping track, I'm in the boat with people who had our deposit money in Escrow, and check made out to Hendricks Abstract.

I have no idea what happens for those of that made checks to THP.

My Fiance was told there is a special procedure in petitioning the court, and there are examples in the court house. If we don't do it correctly, the court won't even look at it.
