Default T.H. Properties - THP - A response to a BBB Better Business Bureau Letter

Today, after being told that there was nothing left the BBB could do, apparently, THP has responded.

Based on the letter, it was to address myself and one additional individual.

The letter addressed to the Trade Practices Consultant at the BBB reads :

...

"This office is counsel to T.H. Properties ("THP"). We are in receipt of and thank you or our May 26, 2009 correspondence regarding a complaint...

...

"As a result, THP must follow the procedures set forth in the Bankruptcy Code to address issues such as those raised by Mr. Crotty..."

"Your office may rest assured, however, that THP is working assiduously within that legal framework to promptly address these issues ... and ultimately it remains THP's intention to finalize negotiations with its lenders in order to resume its various construction projects and deliver completed homes to its customers through the bankruptcy process."

Well, heres to hope that THP remains persistent as stated and starts making business decisions aligned with a company in Chapter 11 which, ultimately, will allow for operations to be funded properly and expeditiously for all parties involved.

I got a similar thing sent to me from BBB. So I have to file a claim with the courts & then I have 10 days to let the BBB know if I'm satisfied w/ the resolution.

HA...

I'm coming up on the time when my homeowners policy could be canceled.

Having my situation not resolved, and in light of the policy issue and others, I'll have to go for "more dissatisfied than satisfied".

Oh yeah...I'll be drafting that letter today. THP had my request in writing BEFORE they declared bankruptcy...granted only 7 days & they had "Suspened Operations"...but STILL...I don't buy this...

& now I'm sore, tired, cranky, & sleep deprived from moving in to the in laws this weekend...so I'm a B*TCH on a mission today.

This new find of mine will certainly be going back with my response :

Winter Settler and don't have grading, seeding, or a driveway? Or other stuff?

The weather's looking pretty reasonable outside as well to me to have this matter complete as well.

Yeah, I don't have these things to bring up...just the lies about the permit being in for approval....bad business practices if you ask me...

For those of you thinking about filing a Proof of Claim w/ the courts:

I placed a call there today to see if this was the form needed to be let out of the contract as well (since my escrow $ being given back would essentially break the contract).

I left a message for Chris Wagner (Case Administrator) at 215-408-2800 (sorry no extension - I was patched through)

Default Letter from the BBB

I got this letter last week from the BBB...didn' have chance to post about it until now...

It basically says that they don't process complaints about bankrupt companies....& that the recommend we file a Proof of Claim w/ the courts...

seems like everyone is giving us the same line.

General sense : THP is protected, the consumer is not.
