HOA dues at Coddington

Once again...if you are not paying your dues you are hurting the rest of us. I just talked to the service who takes care of the grass cutting at Biltmore(the owner) they are getting paid. And I talked to our trash collector(they are getting paid) The HOA is a separate entity! I don't care if you sent a certified letter to THP and received no response...You people who are not paying are getting a service you are not paying for...This is wrong. I don't care what else THP has done to you...this is a separate issue. So please, if you have not been paying your dues...you need to start. It will eventually catch up to you. Or if you choose not to....then pay for your trash and lawn service out of your pocket and let the HOA know you will no longer be needing their services!

People that fail to pay HOA fees, Condo Fees,Proprietary fees etc. are cheats and nothing less. They are the type of people that would streal cable services when that was in vogue a few years ago for the cheaters and thieves posing as honest citizens and causing honest people to pay higher cable bills.

It is obvious that people like this are a drag on dues paying members and do nothing but harm.

CODDINGON VIEW IS NOT BILTMORE.

If the Biltmore HOA is fulfilling its responsibilities to Biltmore residents - good for them. Biltmore residents should pay their HOA dues for Biltmore.

BILTMORE HOA is, legally, NOT associated with the Coddington View HOA. How much simpler can that be.

They are supposed to be separate entities (if they are not, then that becomes a whole different issue and I believe they would be in even further violation of their responsibilites) . Thus, the issues that Coddington View residents have with OUR HOA have nothing to do with Biltmore residents.

The Coddington VIEW HOA is in breach of their responsibilities to us - The Coddington View residens.

I provided the HOA with a letter outlining the reasons I (as a resident of Coddington View) am withholding my dues to the Coddington View HOA, that I would place my dues in escrow, and that - once they met their legal obligations - I would forward all escrowed money for my dues to them(the Coddington View HOA). I have also called and left several messages at the number they supposedly use (in the THP offices).

Witholding my dues from them for breach of their responsibilities IS MY LEGAL RIGHT. It is not cheating, it is not stealing, IT IS MY RIGHT.

Just to be clear - here is where they are breaching their responsibilities to us.

• We are supposed to have 2 people on the Board (based upon the % of the development sold). Bylaws required all owners to be notified of a election in writing. To date we have not been notified.
• We are supposed to have an annual meeting (and they are required to tell us about it in writing ~60 days beforehand), TO DATE - We have neither been informed of a meeting, nor heard of one.
• We are supposed to be able to audit the HOA books and budgets. We made a request for access to those and listed specific items of concern (contract with landscaper, trash, related were identified) and and have been ignored.

There are several other items that were raised in the letter to the HOA, but these are the highlights.

We sent this letter (via certified mail) to the Association, to THP, and to THP's lawyers. TO DATE they have ignored us.

Accusing concerned members who only want their HOA to live up to its responsibilities, does NOT make us cheats, deadbeats and any of the other things you have called us.

I spoke with several people with the landscape company when they were last around, and was told they had not been paid by the HOA for CODDINGTON VIEW... The fact that the Biltmore HOA is paying the landscaper for BILTMORE has nothing to do with the Coddington View HOA and the Coddington View landscaper.

Thank you neighbor for outlining the real issues and reasons some of us are not paying the HOA fees directly. So the "cheats" of the development are really honest people, unwilling to allow our money to be distributed to God knows where. Several letters and requests by certified mail have gone unanswered. Where is the money going? We have been here a year, were all of you at the meetings? Oh, that is right, there have not been any. Keep paying into an association that is not even abiding by its own terms and rules. What a joke. How dare you call your neighbors cheats? You do not even know our own specific situations. Look at our neighborhood? Wake up please and stop being so ignorant.

For the information of the Coddington view residence. I spoke with a township commissioner the other night and he is going to ask the township solicitor to contact the bankruptcy court judge and THP to see if they can find out who the board of directors are for the Coddington View HOA, and also request other information that my neighbors have concerns with, including warranty work ect. There is a township meeting this Monday night at 7pm. Voice your concerns there. I will be there to voice mine if some issues are not brought up.
